The first provision of Article 96, for instance, seems fair on its face: "Each Party shall accord to investors of the other Party that have suffered loss or damage relating to their investments ... due to armed conflict or state of emergency such as revolution, insurrection, civil disturbance or any other similar event ... treatment ... that is no less favorable than the most favorable treatment which it accords to any investors."

One-sided move

THE HOUSE OF REPRESENTATIVES continues to conduct budget hearings and plans to approve the 2008 budget on second reading at 5 a.m. Friday, Oct. 12. The House hopes to approve it on third reading early next month when it returns from recess. Then it is hoping that the bicameral conference committee will approve it before Christmas.

It's a one-sided move, though, since the Senate has closed shop since last week, contrary to the provision of Art. VI, Sec. 16 (5) that both chambers have to agree on a common date for adjournment. The two chambers had agreed to a three-week recess starting Oct. 12, but many senators could no longer hold off their travel plans and left for Europe last week (including three members of the Cayetano family). What's likely to happen is that a single senator would declare the session to be in recess. Ironically, this chamber received the highest public satisfaction rate among the public, according to the latest SWS poll.

ONE of the strangest things to come out of the back-and-forth between advocates and critics of the Japan-Philippines Economic Partnership Agreement (JPEPA) is that we import only 12 percent of cars and parts from Japan. Whatever happened to Toyota, Nissan, Honda? Have they been overtaken by Kia, Ford, Hyundai?

No, says our ambassador to Tokyo, Domingo Siazon, it’s a simple matter of Japan outsourcing their production to Thailand, Indonesia, Malaysia, Brunei, the Philippines, and soon, Vietnam. In short, if JPEPA doesn’t squeak through the Senate, Japanese cars and their parts will be costlier for us to acquire. Not to mention, costlier to the economy in terms of thousands of jobs crashed.
